- If the description of any Goods, which are not directly manufactured by 0T Designs, contained in any correspondence, invoice or the current website varies from that of the manufacturer’s description, then the manufacturer’s description will be deemed to be the correct description and shall take precedence over the description assigned by 0T Designs. - In the event of any material change to any description of goods since the date of publication of published by on www.0TDesigns.com, 0T Designs will advise the Customer of the revised description at the time of delivery of the goods or before where possible.
- 0T Designs reserves the right without prior notice to discontinue any Goods or to make design changes as part of a continuous programme of improvement or to assist availability.

Any published information by 0T Designs as to the country of origin of Goods is an indicator only of the source of supply to 0T Designs and does not constitute a warranty or representation. - All prices for the Goods are in pounds Sterling and subject to Value Added Tax (“VAT”) at the relevant rate ruling on the date of despatch and do not include the cost of carriage, packaging or other charges which becomes payable under any contract with 0T Designs. Prior to the conclusion of the contract, 0T Designs will inform the Customer the total amount to be debited.
- Whilst every endeavour will be made to maintain the prices published by on www.0TDesigns.com, 0T Designs reserves the right to alter prices at any time. Prior to the conclusion of the contract, 0T Designs will inform the Customer the total amount to be debited.
- Any change in price will be communicated to the Customer at the time of ordering. Prior to the conclusion of the contract, 0T Designs will inform the customer the total amount to be debited.
- Electronic Communication – When you visit 0T Designs .com or send emails to us, you are communicating with us electronically. We communicate with you by email or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that those communications be in writing. This condition does not affect your statutory rights.
2. Ordering
The availability information for products sold is included on each product information page. Please note that we cannot guarantee despatch dates and all despatch dates given are estimates. In the event that the product you ordered is unavailable, we will let you know by email.
We describe every item on our website as accurately as we can. However, occasionally product descriptions or pricing errors occur. If after you have submitted your order we discover such an error or the item ordered becomes unavailable, we will do our best to inform you at the earliest opportunity. You may then choose whether to proceed with your order or cancel it. If we cannot contact you, we may treat your order as cancelled.

- 0T Designs reserves the right to deliver part orders, or hold orders until all items are available, as required.
- Acceptance of an internet order placed by a Customer and the completion of the contract between the Customer and 0T Designs will take place when the Customer receives an email from 0T Designs that confirms that the Goods have been dispatched “Dispatch Confirmation”. The Contract between us will only be formed when 0T Designs sends the Customer the Dispatch Confirmation.
- If 0T Designs is unable to supply the Customer with a Good, for example, because that Good is no longer available, or because of an error in the price on 0T Designs website, or 0T Designs is unable to obtain authorisation for the Customer’s payment, or where the Customer does not accept 0T Designs terms and conditions of sale, 0T Designs will inform the Customer of this by e-mail, for internet orders and 0T Designs will not process the Customer’s order. If the Customer has already paid for the Goods, 0T Designs will refund the Customer the full amount as soon as possible and in any event within 14 days.
- ACCEPTANCE BY 0T DESIGNS OF ANY PAYMENT MADE BY THE CUSTOMER IN CONNECTION WITH ANY GOODS DOES NOT CONSTITUTE 0T DESIGNS ACCEPTANCE OF THE CUSTOMER’S ORDER AND A LEGALLY BINDING CONTRACT IS NOT FORMED UNTIL THE CUSTOMER RECEIVES 0T DESIGNS DISPATCH CONFIRMATION E-MAIL AND 0T DESIGNS WILL NOT BE OBLIGED TO SUPPLY GOODS TO THE CUSTOMER UNTIL THEN.
3. Payments

- Payment shall be made by the Customer for all monies owed to 0T Designs in respect of orders placed for Goods.
- Under normal circumstances, payment shall be made at the time that the order is placed. Payment may be made by and is accepted by, cash, cheque or major credit and debit cards: (Maestro, MasterCard, Visa and American Express). Paypal (online only).
- If the Customer fails to make payment for the Goods in accordance with these Terms and Conditions or permits any other breach of any contract for sale or if any distress or execution shall be levied upon any of the Customer’s goods or if the Customer offers to make any arrangement with its creditors or if any petition in bankruptcy is presented against the Customer or the Customer is unable to pay its debts as they fall due or if being a limited company any resolution or petition to wind up the Customer (other than for the purpose of amalgamation or reconstruction without insolvency) shall be passed or presented or if a Receiver, Administrative Receiver or Manager shall be appointed over the whole or any part of the Customer’s business or assets or if any petition for the appointment of any administrator is presented against the Customer or if the Customer shall suffer any actions or proceedings under foreign law all sums outstanding in respect of the Goods shall become payable immediately.
4. Delivery
When ordering goods from 0T Designs for delivery outside of the UK the recipient may be subject to import duties and taxes, which are payable once the package reaches the specified destination. Any additional charges must be borne by the recipient and 0T Designs cannot advise on any customs taxes.
We would like our international customers to note that we are obliged to declare the full value of goods on all packages shipped outside the EU and all cross-border deliveries are subject to opening and inspection by customs authorities.
If delivery can’t be completed due to unpaid import duties, when the parcel comes back to us a £20 fee may be deducted from your refund to cover the return charges and fees that we’re billed by the carrier.

- Delivery is free (within the UK and USA) for all orders inclusive of VAT. Other delivery methods are available at additional cost. The current charge can be ascertained by contacting 0T Designs. Prior to the conclusion of the contract, 0T Designs will inform the Customer the total amount to be debited.
- The risk of damage to or loss of Goods ordered from 0T Designs will pass to the Customer when the goods are delivered.
- Two-day despatch is normally achieved but not guaranteed. All orders will be despatched where reasonably practicable the same working day as the order is received by 0T Designs and normally delivered within two to three working days.
- Carriage will be charged on orders involving Export at the appropriate rate prevailing at the date of despatch. Prior to the conclusion of the contract, 0T Designs will inform the Customer the total amount to be debited.
- The Customer is responsible at their own expense to obtain any import or export license or any other documentation deemed necessary by any compliant authority.
- The Customer must inspect the Goods as soon as reasonably practicable after delivery or upon purchase from a store and shall within 48 hours of such delivery or receipt give notice to the Customer Service Department of 0T Designs (via E-MAIL) of any apparent physical or delivery damage in the Goods.
- Queries regarding shortages of Goods must be made within 24 hours of the delivery date and must be accompanied by the despatch note. Queries regarding Goods invoiced but not delivered must be made to the Customer Service Department of 0T Designs within 24 hours of invoice date and the invoice number must be quoted.
- NOTHING IN THIS SECTION AFFECTS THE LEGAL RIGHTS OF THE CONSUMER. FURTHER INFORMATION ABOUT YOUR CONSUMER RIGHTS ARE AVAILABLE FROM YOUR LOCAL TRADING STANDARDS OFFICE OR CITIZENS ADVICE BUREAU.
5. Returns

- We ask all of our customers to feel free to send all queries and questions about our products to E-MAIL prior to ordering.
- Due to the custom-made and often intimate nature of our products that we supply to you the customer, we are unable to accept unwanted goods. You the customer should contact 0T Designs at E-MAIL with any queries and questions about the suitability of our products prior to ordering.
- In the very rare event that a product received by our customer is faulty, the customer must inform us at E-Mail with 7 days of receiving the product delivery. Due to our strict product quality assurance, this should be a very seldom occurrence. We are proud to be able to respond to all customer queries within 24 hours of receiving correspondence.
6. Intellectual Property & Copyright
First and foremost, we aim to credit and protect our artists and creative for the work produced.

- All content included on this website, such as photographs, text, graphics, logos, button icons, images and software, is the property of 0T Designs, its affiliates or its content suppliers and is protected by intellectual property laws in England and Internationally.
- 0T Designs and its exclusive brands, logos and imageries indicated on our website are trademarks or registered trademarks of 0T Designs and/or it’s partners and may not be used in connection with any product or service that is not 0T Designs, in any manner that is likely to cause confusion among customers, disparages or discredits 0T Designs.
- Goods referred to in any 0T Designs website, correspondence or invoice may be subject to a patent, trademark, registered design, copyright, topography right or other rights of a third party. 0T Designs owns full copyright in respect of any website whether published in paper or electronic form. The reproduction, storage in a retrieval system, or transmission, in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, in part or in whole, is prohibited without the prior written consent of 0T Designs. Notwithstanding any other term of these conditions of sale, title in any software program that forms part of the Goods purchased is retained by 0T Designs and will not pass to the Customer. Such software programs may only be used by the Customer and a revocable non-exclusive licence is hereby granted for the sole use of the Customer (so far as 0T Designs are able to grant such licence) and any software must not be copied or altered or otherwise modified in any way.
- Where any designs or specifications have been supplied by the Customer for the manufacture of Goods by 0T Designs the Customer warrants that the use of such designs or specifications for the manufacture, processing, assembly or supply of the Goods shall not infringe the rights of any third party and the Customer shall indemnify 0T Designs against all costs claims and demands of whatsoever nature arising out of the use of such designs or specifications.
7. Data Protection

- By placing an order with 0T Designs the Customer agrees to data relating to the transaction being retained and processed by 0T Designs in accordance with the Data Protection Act or any statutory modification thereof. The data so retained will be used by 0T Designs for the purpose of accounting and marketing and will not be disclosed to any third party without the previous consent in writing of the Customer.
- 0T Designs may send to the Customer details of other Goods and services offered by 0T Designs that 0T Designs may consider to be of interest to the Customer. If the Customer does not wish to receive details of these offers then they should contact 0T Designs in writing E-MAIL requesting that data is removed from the marketing database. 0T Designs subscribes to the data protection principles as laid down by the Information Commissioner and all data is held securely. The Customer may, by writing to the Customer Service Department of 0T Designs, request that all data relating to them be deleted from its records. Customers may also, in accordance with the provisions of the Data Protection Act, obtain copies of such data that is held in respect of them by 0T Designs.
8. Liability

- If 0T Designs fails to comply with these terms and conditions of sale or our website terms of use, 0T Designs is responsible for loss or damage the Customer suffers that is a foreseeable result of 0T Designs breach of these terms and conditions of sale or our website terms of use or 0T Designs negligence, but 0T Designs is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of 0T Designs breach or if it was contemplated by the Customer and 0T Designs at the time we entered into the Contract.
- 0T Designs only supply the Goods to Consumers for domestic and private use. The Customer agrees not to use the Goods for any commercial, business or re-sale purposes, and 0T Designs has no liability to the Customer for any loss of profit, loss of business, business interruption, or loss of business opportunity.
- 0T Designs does not in any way exclude or limit its liability for:
- death or personal injury caused by 0T Designs negligence;
- fraud or fraudulent misrepresentation;
- any breach of the terms implied by section 17 of the Consumer Rights Act 2015 (title and quiet possession);
- any breach of the terms implied by section 9 to 17 of the Consumer Rights Act 2015 (description, satisfactory quality, match model, pre-contract information, right to supply, installed correctly, digital content, fitness for purpose and samples);
- arising under Section 2(3) Consumer Protection Act 1987; or for any matter which it is not permitted by law to limit or exclude, or attempt to limit or exclude, 0T Designs liability.
9. Force Majeure

- 0T Designs shall not be liable to the Customer or deemed to be in breach of Contract by reason of any delay in performing, or any failure to perform, any obligations of 0T Designs in relation to the Goods, provided that the delay or failure was due to any cause beyond reasonable control of 0T Designs. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond reasonable control of 0T Designs : Act of God, explosion, flood, tempest, fire or accident; war or threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of 0T Designs or of a third party); difficulties in obtaining raw materials, labour, fuel, parts or machinery; power failure or breakdown in machinery.
10. Ownership and Risk
